Many times people accused of crimes falsely believe that cooperating and providing a highly detailed account will convince the police officers to allow them to go home. The chance of this happening is zero. Do not talk the police; it does not get any simplier than that. It has been said many times by criminal defense lawyers and it cannot be repeated enough. Even telling the truth can be twisted to compromise your freedom in the future. Keep your mouth shut. If you refuse to participate in the interview and request a lawyer, you at least give yourself a shot of actually going home. Be polite and respectful but don't volunteer any information. The government will be forced to prove their case against you without the advantage of convicting you with your own words. You have a right against self-incrimination so use it. Please.
This applies equally to almost every criminal case, including DWI, assault and drug possession.
If you receive a letter or phone call from the police department requesting that you participate in an interview, call me immediately. This decision should not be taken lightly or left up to chance.
